These Terms of Service (“Terms”) govern your use of the website and services provided by The Occasionalists Co. (“The Occasionalists,” “we,” “us,” or “our”). By submitting an inquiry, booking a service, renting items, or otherwise engaging our services, you agree to these Terms.
1. Our Services
The Occasionalists provides curated event styling, tablescape design, rental items, and related hospitality services for private gatherings and occasions.
Our services may include:
The Occasion: Full-service styling, sourcing, delivery, setup, breakdown, and pickup.
The Occasion Kit: Curated rental collections of tableware, décor, linens, and other items for clients to use during their gathering.
Add-on Services: Floral styling, food and beverage coordination, tables and seating, printing, and other services or rentals that may be arranged upon request.
Services and availability are subject to the specific details of each occasion and will be confirmed in writing.
2. Inquiries & Bookings
Submitting an inquiry does not constitute a confirmed booking.
A booking is considered confirmed only after The Occasionalists has provided written confirmation and any required deposit or payment has been received.
We reserve the right to decline an inquiry or booking based on availability, location, scope, timing, or other circumstances.
3. Pricing & Payment
Pricing for The Occasion is quoted individually based on the scope of services, guest count, location, design requirements, rentals, and other details of the gathering.
Occasion Kit pricing begins at the rates published on our website and may vary based on the pieces selected, guest count, availability, and additional services.
Any applicable delivery, pickup, rental, vendor, or other fees will be communicated before a booking is confirmed.
Payment terms, including deposits and remaining balances, will be provided with your booking confirmation or invoice.
4. Cancellations & Changes
Cancellation and refund terms will be outlined in your booking agreement or invoice.
Because The Occasionalists may reserve inventory, purchase materials, schedule vendors, and allocate time specifically for your occasion, certain payments may be non-refundable.
Changes to the date, location, guest count, design, or scope of an occasion may affect pricing and availability. We will make reasonable efforts to accommodate changes but cannot guarantee availability.
5. Occasion Kit Rentals
Occasion Kit items remain the property of The Occasionalists at all times.
Clients are responsible for the rental items from the time of delivery or pickup until they are returned to The Occasionalists.
Rental items must be used only for their intended purpose and must not be altered, modified, painted, repaired, or otherwise changed without our written permission.
Clients are responsible for returning all rental items in the condition in which they were provided, excluding reasonable wear from normal use.
6. Damage, Loss & Missing Items
Clients are responsible for any damage, breakage, loss, theft, or missing rental items occurring during the rental period.
If an item is damaged beyond reasonable wear, lost, stolen, or not returned, The Occasionalists may charge the client for the reasonable cost of repair or replacement.
We will communicate any applicable charges to the client following the rental.
7. Delivery, Setup & Pickup
Delivery and pickup arrangements will be agreed upon before the occasion.
The client is responsible for providing accurate delivery information and ensuring reasonable access to the delivery and setup location.
For The Occasion, setup and breakdown services are limited to the services outlined in the client's booking.
The Occasionalists is not responsible for delays caused by circumstances outside of our reasonable control, including traffic, weather, building access, venue restrictions, or other unforeseen circumstances.
8. Client Responsibilities
Clients are responsible for providing a safe and reasonably accessible environment for our team, vendors, and rental items.
Clients must notify The Occasionalists of any relevant restrictions, building rules, venue requirements, stairs, elevators, parking limitations, or other conditions that may affect delivery, setup, or pickup.
The Occasionalists reserves the right to refuse setup or remove our team from a location if we reasonably believe the environment is unsafe.
9. Third-Party Vendors
The Occasionalists may coordinate services provided by independent third-party vendors, including florists, chefs, bakers, rental companies, photographers, or other creative partners.
Third-party services may be subject to additional pricing, terms, availability, and cancellation policies established by the individual vendor.
While we make reasonable efforts to work with trusted professionals, The Occasionalists is not responsible for the independent acts, omissions, delays, or performance of third-party vendors.
10. Photography & Content
Unless otherwise agreed in writing, The Occasionalists may photograph or video our styling, rental pieces, tablescapes, or completed setups for use in our website, portfolio, social media, and marketing materials.
We will make reasonable efforts to avoid identifying guests or including private information without permission.
If you do not want photography or video of your occasion used for promotional purposes, please notify us in writing before the event.
11. Liability
The Occasionalists will take reasonable care in providing our services and handling rental items.
To the fullest extent permitted by applicable law, The Occasionalists is not responsible for indirect, incidental, special, or consequential damages arising from the use of our services or rental items.
Clients are responsible for the conduct of their guests and for ensuring that rental items and styled spaces are used safely and appropriately.
Nothing in these Terms limits any liability that cannot legally be limited or excluded under applicable law.
12. Intellectual Property
All website content, photography, written materials, branding, logos, designs, and other creative materials belonging to The Occasionalists are the property of The Occasionalists Co. and may not be reproduced, copied, or used commercially without written permission.
13. Privacy
Information submitted through our website or inquiry forms will be handled in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. The most current version will be posted on our website with the effective date noted above.
15. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions.
